Thank you for using Cove Studios!
Please read these Terms carefully as they contain important information about your legal rights, remedies and obligations. By accessing or using the Cove Studios Platform, you agree to comply with and be bound by these Terms.
1. Scope of Cove Studios Services
1.1 June Jung Art LLC, through its Cove Studios brand (collectively referred to here as “Cove Studios”), allows a registered tattoo artist (“Artist”) to book time in Cove Studios’ physical tattoo shop space to perform tattooing services on his or her customers (“End-Customers”). Cove Studios also provides the Artist with a digital tool, the Site, to manage reservations of the spaces. Cove Studios may also provide additional digital tools to help the Artist manage relationships with end-customers.
1.2 As the provider of the Cove Studios Platform, Cove Studios does not provide any tattoo services to the Artist’s end-customers. The Artist alone is responsible for the services he or she provides within Cove Studios’ space. When an Artist uses the Cove Studios Platform, Cove Studios is not and does not become a party to or other participant in any contractual relationship between the Artist and his or her customers, nor is Cove Studios a real estate broker or insurer. Cove Studios is not acting as an agent in any capacity for any Artist or end-customer.
1.3 When an Artist uses the Cove Studios Platform, the Artist’s relationship with Cove Studios is limited to being an independent, third-party contractor, and the Artist is not an employee, agent, joint venturer or partner of Cove Studios. The Artist acts exclusively on his or her own behalf and for his or her own benefit, and not on behalf, or for the benefit, of Cove Studios.
1.4 The Artist gets no rights to June Jung or Cove Studios intellectual property
2. Terms of Booking and Payments for Physical Space
2.1 Artists may book physical space as far as 90 days in advance, but no less than 1 day in advance.
2.2 Cancellations must be made no less than 24 hours from the time of your reservation.
2.3 Total reservation cost must be paid by credit card at the time the reservation is made.
2.4 Full refunds are made for cancellations made more than 24 hours before appointment time. No refunds can be made if appointment is not cancelled more than 24 hours from the appointment time.
2.5 Cove Studios may, at any time, change pricing and availability of services.
2.6 Cove Studios may limit frequency of Artists reservations at Sites. For example, one Artist may only be permitted to reserve 20 days in a given 60 day period.
3. Artist Obligations when using Physical Space
3.1 Artists must follow the space's Infection Protection Control Plan for all tattoo procedures. 4666 York Blvd Plan is here.
3.2. All Cove Studio spaces use only disposable instruments. There is no autoclave machine. You will use only disposable instruments while tattooing in Cove Studios space.
3.3 It is the Artists' responsibility to set up and clean up his or her station.
3.4 The artist must certify his or her own compliance with local laws and regulations, and specifically regulations concerning practitioners of body art.
3.5 All interactions and transactions between the artist and his or her end-customer are the responsibility of the artist, and not of Cove Studios. This includes collecting and accounting for all applicable taxes for payments received for tattoo services.
You, as the Artist, acknowledge and agree that the entire risk arising out of your access to and use of the Cove Studios Platform remains with you. To the maximum extent permitted by law, neither Cove Studios nor any other party involved in creating, producing, or delivering the Cove Studios Platform will be liable (1) for any damages to any of your end-customers, or (2) for any damages to you (other than, in the event of a breach of contract by Cove Studios, reimbursement of the amount you paid for use of the Cove Studios Platform), including incidental, special, or consequential damages, including damages for lost profits, loss of data or loss of goodwill, service interruption, computer damage or system failure or the cost of substitute products or services, arising out of or in connection with your use of or inability to use the Cove Studios Platform. This limitation of liability extends to all damage claims, including damages for personal or bodily injury and emotional distress and to punitive or exemplary damages.
